Ratio Decidendi

The court found that the magistrate's court acted in excess of its jurisdiction by issuing orders for the transfer and vesting of land before the confirmation of grant in a pending succession cause. The applicant, as an administrator, did not have the legal capacity to effect transfer of the estate property prior to confirmation of the grant, and the interested party lacked locus standi as she had not produced a grant of letters of administration for her late husband's estate. The issuance of a vesting order in favour of the interested party was therefore improper and without legal basis. Consequently, the orders made on 24th April, 2013, were quashed by an order of certiorari.
