Ratio Decidendi

The court held that the applicant failed to satisfy the statutory precondition for enforcement of a monetary decree against the government, namely, obtaining and serving a Certificate of Order Against the Government as required by section 21(1) of the Government Proceedings Act. The mere attachment of a decree and a Certificate of Taxation does not suffice. Since the applicant had not produced the requisite certificate, the court found that the application for mandamus was premature and could not be granted. The statutory mechanism for compelling government payment of a judgment debt is clear and must be strictly followed. The application was therefore dismissed with costs.
