Ratio Decidendi

The court found that the Msambweni Land Disputes Tribunal acted outside its statutory jurisdiction by entertaining and determining a dispute relating to title to land and by ordering the cancellation of the applicant's registered title. Section 3(1) of the Land Disputes Tribunals Act restricts the tribunal's jurisdiction to matters concerning boundaries, occupation, or trespass, and does not extend to title or ownership. The tribunal's decision, and its subsequent adoption by the Senior Resident Magistrate, were therefore ultra vires and null. The court held that only the High Court or the Resident Magistrate's Court (depending on value) has jurisdiction to determine such disputes....
