Ratio Decidendi

The court held that the Magistrate's Court lacked jurisdiction to adopt the Tribunal's award after the repeal of the Land Disputes Tribunal Act by the Environment and Land Court Act. The purported adoption of the award was therefore null and void. The Tribunal's decision was not a valid order but a mere request, and even if the Act had not been repealed, the Tribunal lacked jurisdiction over disputes arising from a chargee's exercise of power of sale, which are contractual in nature. The absence of a saving clause in the repealing statute meant that no court could exercise powers under the repealed Act.
