Miscellaneous Application / Judgment

  1. 1 Whether an order of mandamus should issue to compel the Respondents to pay the decretal sum and taxed costs as awarded in CMCC No 525 of 2012.
  2. 2 Whether the Ex parte Applicant is entitled to interest on the decretal sum and costs from the date of judgment until payment in full.
  3. 3 Whether the government can be compelled by mandamus to satisfy a monetary decree issued against it.

Ratio Decidendi

The court found that the Ex parte Applicant had obtained a valid judgment and decree against the government, served all requisite documents, and made demands for payment, which the Respondents ignored without justification. Since execution cannot issue against the government, the only available remedy is an order of mandamus to compel payment. The court held that the government is obligated under Section 21 of the Government Proceedings Act to satisfy monetary decrees and cannot defeat lawful claims by inaction. The court further clarified the accrual of interest on the awarded sums and granted the application as prayed, finding no reason to deny the Applicant the fruits of his judgment.

Court Disposition

Application allowed. Order of mandamus granted as prayed.

Orders

  • An order of mandamus is issued compelling the Respondents to pay the Ex parte Applicant the decretal sum of Kshs 975,303 together with interest at 14% per annum from 7th February 2018 until payment in full and the taxed costs of Kshs 222,097.
  • Interest on general damages of Kshs 800,000 and costs awarded in CMCC No 525 of 2012 will accrue from the date of judgment until payment in full.
