Ratio Decidendi

The court found that the text messages exhibited by Raj Sahi were relevant to the issue of representation of the applicant company and were exchanged between the parties directly involved in the dispute. Since the messages had not been disclosed to third parties and were pertinent to the proceedings, their inclusion did not breach Article 31 of the Constitution. The court also held that cross-examination of deponents on affidavits during interlocutory applications should be discouraged unless special circumstances exist, as it would unnecessarily complicate preliminary matters. The applications to strike out the affidavit and to call Raj Sahi for cross-examination were both dismissed.
