The court found that the applicants’ complaints were directed at decisions made by the Mosocho Land Disputes Tribunal and the Chief Magistrate’s Court at Kisii, neither of which were parties to the proceedings. The respondents named in the application—the Hon. Attorney General and Rose Atieno Oluoch—did not make the impugned decisions and were not proper parties against whom judicial review orders could be issued.
