Procedural Posture

Criminal Case / Judgment

  1. 1 Whether the accused caused the death of the deceased by an unlawful act.
  2. 2 Whether the accused acted with malice aforethought as required for the offence of murder.
  3. 3 Whether the accused was insane at the time of committing the offence and thus not criminally responsible.

Ratio Decidendi

The court found that the prosecution proved the death of the deceased and that the accused caused it by an unlawful act. However, the evidence, including eyewitness accounts of the accused's abnormal behavior immediately after the incident and medical reports indicating a history of mental illness, established that the accused was suffering from a mental infirmity at the time of the offence. The court held that the accused was incapable of forming malice aforethought due to insanity, and thus could not be held criminally responsible for murder in the conventional sense. Accordingly, a special finding of 'guilty but insane' was entered under Section 166(1) of the Criminal Procedure Code.

Special finding of guilty but insane entered under Section 166(1) of the Criminal Procedure Code.
