Ratio Decidendi

The court found that the prosecution proved beyond reasonable doubt that the accused caused the death of Inspector Dennis Wanjala by shooting him with an AK 47 rifle at Makueni Police Station. The ballistic and medical evidence corroborated the prosecution's case. However, the court accepted that the accused was suffering from depression at the time, which, while not amounting to legal insanity, negated the presence of malice aforethought required for a murder conviction. The court held that the killing was unlawful but not accompanied by malice aforethought, and therefore convicted the accused of manslaughter under section 202 as read with section 205 of the Penal Code.
