The court found that the prosecution failed to establish a prima facie case against the accused. The evidence presented was largely circumstantial and based on suspicion, with no eyewitnesses to the alleged assault and key witnesses not called to testify. The prosecution did not prove that the fatal injury suffered by the deceased was caused by an unlawful act or omission by the accused, nor that the accused acted with malice aforethought. The court held that, even if the accused offered no defence, the evidence on record was insufficient in credibility and weight to sustain a conviction. Consequently, the accused was acquitted under Section 306(i) of the Criminal Procedure Code.
