Ratio Decidendi

The court found that the prosecution failed to establish a prima facie case against the accused. None of the witnesses saw the accused inflict injuries on the deceased, and the evidence presented did not directly or circumstantially link the accused to the murder. The testimony of the investigating officer was largely hearsay and uncorroborated. The court held that the burden of proof remained with the prosecution, and in the absence of evidence connecting the accused to the offence, it would be unjust to require him to enter a defence. Consequently, the accused was found not guilty under section 306(1) of the Criminal Procedure Code and was acquitted.
