Ratio Decidendi

The court found that the Bomet Central Division Land Disputes Tribunal acted without jurisdiction by determining a matter relating to title to land, which is outside its statutory mandate. The applicant was not afforded a fair hearing, constituting procedural impropriety. The Tribunal's award, subsequently adopted as a judgment by the Magistrate's Court, was therefore tainted with illegality and ultra vires. The court held that procedural technicalities raised by the respondent did not affect the substance of the application, and justice required quashing the impugned decision. Accordingly, the court granted an order of certiorari to quash the Tribunal's award and its adoption as a judgment.
