Applying the legal standard under section 306 of the Criminal Procedure Code and relevant case law, the court held that it is not required at this stage to evaluate the credibility or sufficiency of the evidence for conviction, but only to determine whether there is a ground for proceeding. The evidence, if uncontradicted and believed, would be sufficient to prove the case against the accused. Therefore, the accused is required to be placed on his defence as provided for under section 307 of the Criminal Procedure Code.
