Procedural Posture

Criminal Case / Ruling on No Case to Answer

  1. 1 Whether the prosecution established a prima facie case against the accused to warrant placing him on his defence.
  2. 2 Whether the evidence adduced by the sole prosecution witness was sufficient and credible to establish the material ingredients of the offence of murder.

Ratio Decidendi

The court found that the sole prosecution witness did not know the accused, could not identify him, and did not testify to any fracas or incident involving the accused on the material night. There was no evidence linking the accused to the offence or establishing any of the material ingredients of the charge of murder. The prosecution's evidence was therefore insufficient and incapable of establishing a prima facie case. Consequently, the accused was found to have no case to answer and was acquitted under Section 306(1) of the Criminal Procedure Code.
