The court found that the Butula Land Disputes Tribunal exceeded its statutory jurisdiction by purporting to revoke the applicant's title and order the return of land to a previous owner, powers not conferred by section 3(1) of the Land Disputes Tribunal Act. The Tribunal's decision was therefore null and void ab initio. On the issue of limitation, the court held that the six-month period for filing for leave to apply for judicial review should run from the date the Tribunal's award was adopted by the court, as there was no evidence the parties were notified of the Tribunal's decision prior to that date.
