Ratio Decidendi

The court determined that the substance of the applicant's grievance concerns the process and legality of the renewal of the 5th Respondent's appointment as CEO of a state corporation, which is an employment matter. By virtue of Articles 162(2)(a) and 165(5) of the Constitution and section 12 of the Employment and Labour Relations Act, such disputes fall within the exclusive jurisdiction of the Employment and Labour Relations Court. The applicant, being a trade union, is expressly covered by the jurisdictional provisions. Consequently, the High Court lacks jurisdiction to entertain the application, and the matter must be transferred to the appropriate court for determination.
