The application for mandamus fails because, at the time of filing, the CDF Act, 2003 had been repealed and replaced by the CDF Act, 2013. The applicant's claim was therefore premised on a non-existent statute, and there was no statutory basis to compel the Cabinet Secretary to appoint an arbitration panel. Even if the application were considered under the CDF Act, 2013, the applicant had not complied with the mandatory dispute resolution procedure, which requires parties to first attempt to appoint an arbitration panel by consensus before the Cabinet Secretary's intervention is sought.
