Ratio Decidendi

The court found that the ex parte applicants had complied with all statutory requirements under section 21 of the Government Proceedings Act by obtaining and serving the certificate of costs. The respondents, as government officers, have a public duty to satisfy the decree. Since execution cannot issue against the government, the only available remedy is an order of mandamus to compel payment. The court held that the applicants are entitled to the fruits of their judgment and that failure by the respondents to pay the decretal sum constitutes an injustice. The court therefore issued an order of mandamus compelling the respondents to pay the decretal sum and awarded costs to the applicants.
