Ratio Decidendi

The court found that the order sought to be stayed was a dismissal order, which is negative in nature and incapable of being stayed as there is nothing to execute except for costs, which had not yet been ascertained. Furthermore, even if an order of certiorari had been granted, the court lacks jurisdiction to stay such orders as they are final and not executable; they can only be reversed on appeal. The Environment and Land Court, in judicial review proceedings, cannot grant an injunction or stay of certiorari under Section 8 of the Law Reform Act. The application for stay of execution therefore lacked merit and was dismissed.
