Procedural Posture

Judicial Review Application / Ruling on Reference Against Taxation of Costs

  1. 1 Whether the reference against the Deputy Registrar's taxation is incompetent for want of compliance with Rule 11(1) of the Advocates Remuneration Order.
  2. 2 Whether the Deputy Registrar erred in awarding Kshs 1,350,000 as instruction fees and Kshs 450,000 as getting up fees.

Ratio Decidendi

The court found that the Respondent's omission to file a formal notice of objection was not fatal, as the reference was filed within the prescribed time and contained the substance of the objections. The court held that the Deputy Registrar correctly applied the relevant provisions of the Advocates (Remuneration) Order, considered all relevant factors, and exercised her discretion judiciously in awarding instruction and getting up fees. There was no error of principle or manifest excessiveness in the fees awarded. The court further held that getting up fees are applicable in judicial review proceedings where the matter is contested and proceeds to hearing, even if by affidavit evidence....
