Procedural Posture
Criminal Case / Ruling on Prima Facie Case Under Section 306(2) Criminal Procedure Code
Legal Issues
- 1 Whether the prosecution has established a prima facie case against the accused to warrant her being placed on her defence.
Ratio Decidendi
The court found that the prosecution, having called seven witnesses, presented sufficient evidence to establish a prima facie case against the accused. Consequently, the accused is required to be placed on her defence in accordance with section 306(2) of the Criminal Procedure Code. The ruling does not determine guilt but finds that the evidence, if uncontroverted, could potentially sustain a conviction, thus necessitating the accused to respond to the case against her.

Orders
