The court found that the Land Disputes Tribunal acted outside its jurisdiction as prescribed by Section 3(1) of the Land Disputes Tribunal Act by making a decision that interfered with ownership and title of registered land, which is not within the tribunal's mandate. The tribunal's award, and its subsequent adoption as a judgment by the Eldoret Chief Magistrate's Court, were therefore nullities in law. Procedural irregularities cited by the respondents, such as failure to notify the Registrar or discrepancies in affidavit dates, were found to be curable irregularities that did not render the application fatally defective.
