Ratio Decidendi

The Court of Appeal held that judicial review proceedings are special in nature and are governed exclusively by the Law Reform Act and Order 53 of the Civil Procedure Rules. The High Court erred in importing provisions of the Civil Procedure Act and Rules to extend time for filing a substantive judicial review motion. The court has no jurisdiction to extend time in such proceedings unless expressly provided for by the relevant statute or rules. Consequently, the order extending time for filing the judicial review motion was made without jurisdiction and must be set aside.
