The High Court held that the Business Premises Rent Tribunal is a creature of statute and can only exercise jurisdiction as expressly provided by the Landlord and Tenant (Shops, Hotels and Catering Establishments) Act. The agreement between the applicant and the interested party was for a period of five years and three months, which falls outside the statutory definition of a controlled tenancy. There was no evidence that the Minister had declared the tenancy controlled under Section 2(2) of the Act.
