Ratio Decidendi

The court found that the Amukura Land Disputes Tribunal lacked jurisdiction to determine a claim for ownership of registered land and to adjudicate contractual rights arising from a sale agreement, as such matters fall outside the scope of section 3(1) of the Land Disputes Tribunal Act. Furthermore, the Tribunal was not properly constituted, as the proceedings were signed by only two members instead of the required three or five, and there was no evidence that the third named individual participated in the hearing or decision. As a result, the Tribunal's decision was ultra vires, null, and void. The Principal Magistrate's Court at Busia was therefore prohibited from enforcing or executing...
