The High Court found that the Land Disputes Tribunal, Kitui District, Mutomo Division, exceeded its statutory jurisdiction by determining the question of ownership of land, a matter reserved for courts of law under the Land Disputes Tribunals Act. The Tribunal's award, which declared ownership in favour of the Interested Party, was therefore made without jurisdiction. The Court further held that the Tribunal was properly constituted as a Kitui District Tribunal, and not as a Mutomo Division Tribunal, thus dismissing the applicant's argument on improper constitution.
