The court found that the Siaya Land Disputes Tribunal acted outside its statutory jurisdiction by purporting to determine a dispute over title to registered land, which is expressly excluded from its mandate under Section 3(1) of the Land Disputes Tribunal Act and Section 159 of the Registered Land Act. The Tribunal's award, which would have resulted in the cancellation or revocation of the Exparte Applicant's title, was therefore ultra vires and unlawful. Additionally, the Exparte Applicant was not served or afforded a fair hearing, contravening Article 50 of the Constitution and the rules of natural justice.
