Ratio Decidendi

The court found that the Lugari Land Disputes Tribunal exceeded its jurisdiction by ordering the cancellation or rectification of land title, powers not granted under Section 3(1) of the Land Disputes Tribunal Act. The adoption of the Tribunal's award by the Senior Resident Magistrate's Court did not cure the jurisdictional defect, as orders made without jurisdiction are nullities ab initio. The court relied on the Court of Appeal decision in Asman & Another v Francis Biketi, which affirmed that such orders can be quashed by judicial review. The application for certiorari was therefore merited and allowed, with each party to bear its own costs.
