The court found that the Mauche Land Dispute Tribunal acted in excess of its jurisdiction by purporting to determine the ownership of registered land, which is expressly excluded from its mandate under Section 3(1) of the Land Disputes Tribunals Act, 1990 (repealed). Both the ex parte applicant and the interested party held title deeds to the disputed land, making the dispute one of ownership of registered land. As such, the tribunal's decision and its subsequent adoption by the Chief Magistrate's Court were nullities.
