Procedural Posture

Judicial Review / Judgment

  1. 1 Whether the Meru Central District Land Disputes Tribunal had jurisdiction to order cancellation and subdivision of title to land.
  2. 2 Whether the tribunal's decision was ultra vires the Land Disputes Tribunal Act section 3(1).
  3. 3 Whether orders of certiorari and prohibition should issue against the tribunal's decision.

Ratio Decidendi

The Meru Central District Land Disputes Tribunal exceeded its jurisdiction by ordering the cancellation and subdivision of the applicant's registered title to parcel No. Kiirua/Ruiri/4549. Section 3(1) of the Land Disputes Tribunal Act restricts the tribunal's jurisdiction to disputes concerning boundaries, occupation, or trespass to land, and does not extend to matters of title or subdivision of registered land. The tribunal's decision was therefore ultra vires and void. The High Court, relying on statutory provisions and binding precedent, found that only the High Court or a Resident Magistrate's Court with proper jurisdiction may adjudicate disputes involving title to land....
