Procedural Posture

Judicial Review / Ruling on Notice of Motion for Certiorari

  1. 1 Whether the Land Disputes Tribunal had jurisdiction to order cancellation and alteration of registered land titles.
  2. 2 Whether the Tribunal acted ultra vires by determining interests in land and directing the Land Registrar to issue new titles.
  3. 3 Whether the adoption of the Tribunal's award as a judgment by the Magistrate's Court was lawful.

Ratio Decidendi

The court found that the Land Disputes Tribunal exceeded its statutory mandate by determining interests in land and ordering the cancellation and alteration of registered titles. The Tribunal's jurisdiction is limited to matters of boundary, occupation, and use of land, but does not extend to issues of title or the power to direct the Land Registrar to cancel or issue new titles. The adoption of the Tribunal's award by the Magistrate's Court did not cure the jurisdictional defect. Consequently, both the Tribunal's award and the judgment adopting it were quashed as being ultra vires and null and void.

Court Disposition

Application allowed. Tribunal award and Magistrate's Court judgment quashed. Each party to bear own costs.
