Ratio Decidendi

The court found that the Nyeri Municipality Land Disputes Tribunal acted outside its statutory jurisdiction by determining a dispute based on contract and ownership of land, matters not contemplated under Section 3 of the Land Disputes Tribunals Act. The Tribunal's mandate was limited to disputes concerning boundaries, occupation, or trespass to land. As such, its decision was a nullity and incapable of being lawfully adopted by the Chief Magistrate’s Court. The court held that any proceedings or orders arising from such a decision were void ab initio and granted the order of certiorari to quash both the Tribunal's award and the subsequent judgment and decree of the Chief Magistrate’s Court.
