Miscellaneous Application / Ruling on Judicial Review Application for Certiorari

  1. 1 Whether the Sirisia Land Disputes Tribunal had jurisdiction to determine disputes relating to land registered under the Registered Land Act, Cap.300.
  2. 2 Whether the tribunal's decision to order surrender of 2 acres of registered land was ultra vires.

Ratio Decidendi

The court found that the Sirisia Land Disputes Tribunal acted without jurisdiction in entertaining and determining a dispute relating to land registered under the Registered Land Act, Cap.300. The tribunal's statutory jurisdiction is limited to matters involving division, boundaries, occupation, or trespass to land, and does not extend to disputes over title or ownership of registered land. The tribunal's decision to order the applicant to surrender 2 acres of registered land to the interested party was therefore ultra vires and null and void. Consequently, the court granted an order of certiorari to quash the proceedings and decision of the tribunal, as adopted by the Bungoma court.

Court Disposition

Application allowed. Tribunal proceedings and award quashed. Costs to the applicant.

Orders

  • The proceedings and decision of the Sirisia Land Disputes Tribunal, as adopted by the Bungoma court, are quashed.
