The court found that the Suneka Land Disputes Tribunal (1st respondent) acted outside its statutory jurisdiction under the Land Disputes Tribunals Act by entertaining and determining a dispute concerning title to land registered under the Registered Land Act and involving the estate of a deceased person. The tribunal had no power to order cancellation of title or to adjudicate on matters of succession, as such jurisdiction is reserved for the High Court and, in limited cases, the Magistrates Courts.
