The High Court held that the Land Disputes Tribunal acted in excess of its statutory jurisdiction by awarding mesne profits in the sum of Kshs. 74,710/=, as the Tribunal is not empowered under Section 3 of the Land Disputes Tribunal Act to grant damages or mesne profits. However, the Tribunal was within its jurisdiction to determine the claim of trespass and to restrain the applicant from entering and ploughing the suit land. The court exercised its supervisory jurisdiction to quash only the unlawful portion of the award (mesne profits) while retaining and enforcing the lawful order restraining trespass.
