Ratio Decidendi

The court found that the Webuye Land Disputes Tribunal acted in excess of its jurisdiction by ordering the subdivision and transfer of registered land, which is not permitted under Section 3(1) of the Land Disputes Tribunal Act. The Tribunal's powers are limited to determining disputes relating to boundaries, claims to occupy or work land, but not to ownership or subdivision of registered land. The award was therefore ultra vires and could not stand. The court issued an order of certiorari to quash the Tribunal's award.
