The court found that the Land Disputes Tribunal exceeded its jurisdiction by making an award that effectively determined issues of trust and inheritance over registered land, matters which are outside the tribunal's statutory mandate under the Land Disputes Tribunal Act. The interested party's claim was either that the applicant held the land in trust for the family or that the interested party was entitled to inherit the land as a child of the deceased, both of which should have been pursued through a succession cause or civil proceedings, not before the tribunal.
