Ratio Decidendi

The court found that the Emuhaya Divisional Land Disputes Tribunal exceeded its jurisdiction by purporting to nullify a sale agreement between the registered owner and the applicant. The tribunal's mandate did not extend to disputes over title or ownership of registered land. The rights of a registered proprietor, as protected by statute, cannot be defeated by claims of ancestral entitlement by the proprietor's sons. The tribunal's decision had the effect of unlawfully depriving the registered owner of his proprietary rights. Accordingly, the court allowed the application for certiorari and quashed the tribunal's proceedings and award.
