The court found that the Business Premises Rent Tribunal lacked jurisdiction to entertain the complaints consolidated into Tribunal Case No. 330 of 2011 because the lease between the 1st and 2nd interested parties had been terminated and new leases had been entered into between the ex-parte applicants and the 2nd interested party. The respondent failed to inquire into its jurisdiction in light of these new leases and proceeded to hear a matter that was not properly before it.
