Ratio Decidendi

The court found that the accused stabbed the deceased during a fight that arose after the deceased repeatedly accused the accused of involvement in the theft of headphones. Although the accused was not the thief, the confrontation and ensuing fight constituted provocation as defined under section 208 of the Penal Code. The court held that the accused acted in the heat of passion caused by this provocation, and therefore, the requisite malice aforethought for murder was not established. The court reduced the charge from murder to manslaughter under section 205 of the Penal Code and convicted the accused accordingly.
