Legal Issues
- 1 Whether the accused should be granted bail pending trial given the security concerns raised in the pre-bail report.
Ratio Decidendi
The court declined to grant bail to the accused after considering the pre-bail report, which indicated that the accused's security could not be guaranteed if released to his home environment. The judge determined that it would be safer for the accused to remain in custody and attend trial, rather than risk his safety by releasing him to an unclear and potentially unsafe environment. The court left open the possibility for the accused to renew the bail application at a later date should circumstances change.
Court Disposition
Bail denied. Accused to remain in custody. Liberty to renew application.
Orders
- Bail is declined at this stage.
- The accused may renew the application at a later date.

CHARLES KIRANKI M’IMUTI.......................ACCUSED
R U L I N G
1. I have considered the application for bail and the pre-bail report. The report shows that the security of the accused cannot be guaranteed. It is safe to have the accused attend the trial then release him to an unclear environment that is his home.
2. I decline therefore to grant bail. He may renew the application at a later date.
