Legal Issues
- 1 Whether the accused's mitigation and status as a first offender should affect the sentence imposed for murder.
- 2 Whether the circumstances and brutality of the offence warrant a departure from the death penalty.
Ratio Decidendi
The court acknowledged the accused's status as a first offender and his remorse as mitigating factors. However, the court found that the brutal manner in which the offence was committed constituted a significant aggravating factor. Balancing these considerations, the court determined that the death sentence previously imposed should be set aside and replaced with a term of 25 years imprisonment, commencing from the date of the earlier sentence. The court thus exercised its discretion to impose a custodial sentence rather than the death penalty, reflecting both the mitigating and aggravating circumstances of the case.
Court Disposition
Death sentence set aside; accused sentenced to 25 years imprisonment from date of earlier sentence.
Orders
- The death sentence is set aside.
- The accused is sentenced to 25 years imprisonment from the date of the earlier sentence.
