Ratio Decidendi

The court found that the Land Disputes Tribunal acted outside its statutory jurisdiction by purporting to determine a dispute involving registered land and ordering the cancellation of a valid title deed. The tribunal's powers under the Land Disputes Tribunals Act did not extend to registered land, and any decision made in excess of jurisdiction is a nullity. Consequently, the tribunal's decision, as adopted by the SPM's Court at Kitale, was quashed by an order of certiorari. The ex-parte applicant was entitled to costs from the third respondent only.
