The court found that the evidence adduced by the 12 prosecution witnesses was sufficient to establish a prima facie case against the accused. Applying the legal standard under Section 306(2) of the Criminal Procedure Code and the test in Ramanlal Trambaklal Bhatt v R, the court held that a reasonable tribunal could convict the accused if no explanation is offered. Therefore, the accused is required to be placed on his defence to answer the charge.
