The court found that it lacked jurisdiction to entertain the applications dated 13th July 2020 and 1st August 2020 because the dismissal of the earlier Nairobi application for non-attendance was a final order in judicial review proceedings. Under section 8(3) and (5) of the Law Reform Act, the only remedy available to the Ex-parte Applicants was to appeal to the Court of Appeal, not to file fresh proceedings or seek review or setting aside of the dismissal order in the High Court.
