The Employment and Labour Relations Court found that the Chief Magistrate Court, Migori, exceeded its jurisdiction by entertaining and issuing orders in Migori CMCC No. E012 of 2023. Although Magistrates Courts have jurisdiction to hear employment matters, this is subject to pecuniary limits as delegated by Gazette Notice No. 6024 of 22nd June, 2018, which sets the limit at Kshs. 80,000. The dispute in question involved the removal of members from the Migori County Public Service Board, an employment matter falling within the exclusive jurisdiction of the ELRC.
