The proceedings and orders issued by the Chief Magistrate's Court at Thika after the withdrawal of Civil Suit No. 30 of 2015 were tainted with procedural irregularity and were therefore unlawful. The court found that procedural defects in intitulement, affidavits, or the inclusion of constitutional grounds in a judicial review application are not fatal if they do not affect jurisdiction or cause prejudice.
