The court found that Section 162 of the Criminal Procedure Code governs the procedure when an accused is found unfit to plead due to insanity. The court distinguished the present case from Republic v SOM [2018] eKLR, noting that in the cited case the accused had been found guilty but insane, whereas here the accused had not yet pleaded. The court held that, since murder is a bailable offence and no compelling reasons were demonstrated to deny bond, it would be in the best interest of the accused to be released to a family member rather than committed to a facility.
