Ratio Decidendi

The court found that there was no legal basis to summon Mr. Tim Wamiti for cross-examination because he had not sworn any affidavit in the proceedings. Cross-examination is only warranted where a witness has provided affidavit evidence that is in dispute and requires clarification. The court further held that the application to summon Mr. Wamiti appeared to be a fishing expedition and could amount to an abuse of the court process. In judicial review proceedings, the calling of witnesses is sparingly allowed, and the issues should be determined on the basis of affidavit evidence already on record. Accordingly, the application to summon Mr. Tim Wamiti for cross-examination was dismissed.
