Ratio Decidendi

The court found that the applicants had previously filed a judicial review application (Nyeri ELRC JR No.6 of 2019) seeking the same orders of mandamus to compel payment of the decretal sum, which was heard and determined on its merits by a competent court. The applicants did not appeal or otherwise challenge that decision. The present application, being between the same parties and concerning the same subject matter, is therefore barred by the doctrine of res judicata as codified in section 7 of the Civil Procedure Act. The court is functus officio and cannot entertain a fresh application on the same issues. The applicants' attempt to relitigate the matter is an abuse of court process....
